Terms and Conditions of Funding

Funding from Te Paepae Ataata Trust will be conditional upon a minimum of the following terms and conditions:

Chain of Title

You must establish clear title to your film project as a pre-condition to the development funding.

Approvals

Te Paepae Ataata will take approval rights over each stage of development.

Recoupment

50% of the Development Funding will be repaid to Te Paepae Ataata no later than the first day of principal photography of any film or television production based on your development work. The remaining 50% will be in the form of an equity participation by Te Paepae Ataata in the exploitation of and revenues earned from the production. This 50% will give Te Paepae Ataata an equity position equal to the percentage that this investment constitutes as against the final budget of the production.

Copyright Ownership

Te Paepae Ataata will require you to assign a share of all rights including copyright in the development work to Te Paepae Ataata as security for its investment. Te Paepae Ataata will take a 50% share of such rights, with 50% to be retained by you. As set out above, Te Paepae Ataata will require repayment of its development funding no later than the first day of principal photography of any film or television production based on your screenplay, at which time Te Paepae Ataata will assign its share of the copyright and other rights back to you (or your assignees).

Credit

Te Paepae Ataata will require a contractual end credit on a separate card in the following form: Developed with the support of Te Paepae Ataata and the New Zealand Film Commission. This must be followed by Te Paepae Ataata's and the New Zealand Film Commission's brand visual on all feature films assisted by development funding from Te Paepae Ataata and a credit on the cover of all scripts must be given in the form Developed with the assistance of Te Paepae ATaata and the New Zealand Film Commission.

Delivery

All development material must be delivered by the specified delivery dates in the Development Agreement. Materials must contain a cover sheet with the name of the film and draft number.

What happens after you have received funding and delivered your final material?

Once you have delivered to Te Paepae Ataata, and provided that delivery has been accepted by the Paepae, you will be free to continue to develop your project or to put it into production, working with producers or other financiers. In order to secure repayment of Te Paepae Ataata's development funding, you will not be able to assign, license or otherwise transfer any rights to the development work without the prior written approval of Te Paepae Ataata.
